Yes, indeed it is Microsoft that needs to "smarten up."
They made it pretty clear that they were going to address the exploitations that were letting some people steal software.
Nobody will successfully take them to court for the content of future-looking statements they may have said about what their future software update will contain. If the readme tells you it won't address that issue, but it does, then you'd have a possible (albeit EXTREMELY weak) case.
Finally, your justification that they not address piracy because you or others feel that the quality of their initial release was poor, makes absolutely no sense. You would seem to assert that they have an obligation to provide with and you have some human right to receive pirated software free and clear of any flaws. On the contrary, if the initial release was of poor quality, then only paying customers had
any right to use it and any right to have those flaws repaired.
If you steal my car with old tires on it, you have no right to sue me if I won't give you a free set of new tires.
