Vista - OEM License

OEM License

Ok customer buys 2 new servers and Windows 2008 standard OEM to install on
each box. If he wants to virtualise a windows 2003 server and and windows
2008 server on each of the 2 new servers can they purchase OEM, or must it
be retail product for the virtualised servers?

Is there a Microsoft License Document that covers this.

They can be OEM licenses - you are not required to use retail (also known as
FPP - Full Packaged Product) or Volume licensed products for the VM hosted
OS.
The only issue you have using OEM product is that the OEM license is tied to
the first piece of hardware the license is installed to and is not
transferable. So the VM you create cannot be moved to another host from the
first host it is installed to. This is the same for all OEM licensed
operating systems in that even if you scrap the machine it is installed to
the license dies with it. The fact it is installed to a VM does not help
as the license is tied to the hardware the OS is executing on - in this case
the VM host.
