Vista - Vista DVD burning problems

ok there is a big problem with the DVD writing program integrated in vista..
usually most DVD-R media is about 4.38gb in space, I tried to burn up to
4.35gb of data on that DVD-R disc and vista will not let me burn because it
says i am trying to burn 4.38gb of data on a 4.35gb Disc..
what is wrong with this program?? i am trying to burn some DVDs and i have
never had a problem with this on my old programs..
i also try to install other dvd writing programs (such as intervideo win dvd
copy) vista will not work with that software
what is wrong here??
