Carefully read the fourth paragraph that reads “The companies that sent the letter, grouped as the European Committee for Interoperable Systems,” <(in part) identifies the factual complainers. The commission's spokesman on competition issues, Jonathan Todd, said the European Union had first received the complaint in February last year, adding that the companies had sent additional information last December. The latest letter urges the commission to take action "as fast as possible." (SUNW) is known for raising eyebrows, but the company's announcement last week that KKR Private Equity Investors would invest $700 million has left some on Wall Street dumbfounded. After all, Sun Microsystems isn't exactly poor - it ended the fourth quarter with $4.8 billion in its coffers - and doesn't appear to have many obvious takeover targets on its radar screen. That, industry watchers said, has led to speculation that Sun could use its newfound cash for everything from buybacks to fending off would-be suitors. "They don't need the cash," said Josh Farina, an analyst at Hampton, N.H., market research firm Technology Business Research. "One possibly is its a hedge to keep other buyout firms from coming in." In conjunction with its fiscal second-quarter earnings report last week, Santa Clara, Calif.-based Sun Microsystems announced KKR Private Equity Investors would invest $700 million and get a seat on Sun's board. Sun said last week that the investment wasn't a precursor to the company going private, but that it would consider additional investments similar to KKR. The investment from KKR is comprised of $350 million of convertible senior notes due 2012 and $350 million of convertible senior notes due in 2014. Sun Chief Executive Jonathan Schwartz said last week that the deal would give Sun a business partner to open doors and consult with on strategy and that the cash will be used for growth initiatives, including mergers and acquisitions. While Sun could use the cash for acquisitions, the idea of the company trying to prevent a buyout isn't that much of a stretch. Back in April 2005, Sun's stock got a lift after BusinessWeek reported that Chief Executive Scott McNealy was considering taking the company private with the help of Silver Lake Partners. That never came to be, and CEO McNealy eventually stepped down in April.
