Are you licensed to sell OEM software? If you aren't then adding hardware
makes no difference. Anyway, you already have it up for sale so why are you
asking now? :) If you want a legal opinion on such an offering then
contact your local Microsoft office for binding advice. Otherwise, just
sell it. I don't think you are in any trouble.

no i didnt activate it its brand new unused

In that case just sell the software. Forget the hardware. Many vendors
legally sell the OEM version without qualifying hardware. They get away
with it just fine.

Just be careful when leaving your house. If you see guys in trench coats
with dark sunglasses, beware. They could be the Microsoft Police and they
just might put you in jail. Selling Microsoft software is a major offense
in their eyes!

I bought ultimate for my last laptop & activated it & used it.
Sold the laptop after putting XP back on it & installed the same Vista
on my new laptop (Vista home premium came with the new machine in the
form of a restore disk but it installs all the bundled rubbish).

Had to do a phone activation but just told them I had changed laptops &
removed it from the old, which I had.
Also, this is a OEM disc, they asked how I bought it & told them the
truth, over the counter at a local store.

Had no problems activating, was up & running in 10 mins.

Then you got VERY LUCKY. You can not move the OEM version from machine to
machine. Regardless of you removing it or not.

An OEM license? Has it ever been installed on any computer? Did it
come with a new computer that you purchased? If the answer to any two of
these question is "Yes," then you may not legitimately sell it. An OEM
license, once installed, is not legitimately transferable to any other
computer under any circumstances.

I've done it before...I think the key is telling them I bought it over
the counter at a local store which I did, with no qualifying hardware.
Joe Bloggs probably hasn't even heard of the differences between OEM &
retail versions.
Works for me everytime & i'm being 100% honest in the answers i give them.
