Recycle Bin

My recycle bin desktop icon shows a file being in there; yet when I open the bin, nothing is there.

If I click on "empty recycle bin" it asks me if I'm sure I want to delete "Windows"?

How did it get there, how do I get it out, and what's the repercussions of deleting it? Is it a necessary file? I dont know how to tell.

Help, please?
