what is ''auto''..??, what size is your monitor..??

GTA4 is badly coded & not a very good judge of your FPS....

have you run... 3dmark 06 / vantage......the 06 score should be in the 18-19k range, not sure about vantage..??

you may need the OC reset, but im not sure if you can do this yourself as it may void any warranty you have... find out if altering BIOS functions is OK & i will walk you through putting it back to factory settings....;), but even this may not solve your problems...

if i were you try for a total refund, & build a rig with the cash......

But I thought this set up would be able to max out the settings

Nothing will play GTA IV or Crysis maxed and smoothly :p

With my rig and Crysis, I can play at 1920x1200 with most settings at high with a couple at enthusiast with a 30fps avg, but it's extremely laggy. Instead I choose 1280x720 with x4AA and all settings (except textures) at enthusiast and the gameplay is extremely smooth.

With those specs, COD 4 should be running smooth as butter, even at 1920x1200 with x4AA enabled. In the COD 4 menu, have you set the option "Dual Video Cards: Yes"?

With ALL games, it's always best to manually adjust the settings. AUTO settings invariably make the gameplay either poor or you'll be playing in much lower quality than you need to.

If you still have laggy gameplay after trying lower settings and resolutions, then I'd considering returning the machine.

The i7s run GTA IV amazingly, though. GTA IV is very CPU dependent, and the i7s are the only processors to be able to run it without breaking a sweat.

If you are having problems with other games though, then it does seem like a problem with your graphic card.

Have you checked the temperatures of your graphic card?
